Terms of use

The agreement that governs your use of Kortalo.

These terms are written in French and in English. The French version is authoritative.

These terms (the “Terms”) form an agreement between you and InnovE-Tech Solutions inc., a company of Quebec, Canada (“we”, “us”). They govern the use of the Kortalo Android application (the “App”) and of the kortalo.com website. By installing or using the App, you accept these Terms.

1. Who the agreement is with

The App is published by InnovE-Tech Solutions inc., Quebec, Canada. It is distributed by Google Play; the Google Play terms also apply to its download and purchase, between you and Google.

2. The App and its licence

Kortalo computes cutting plans for materials sold by length (boards, battens, mouldings, tubes) and gives a shopping list, a diagram of each bar, a workshop mode and an offcut inventory. It works offline, on your phone, with no account and no online service of ours.

We grant you a personal, non-exclusive and non-transferable licence to use the App, on the devices linked to your Google Play account, in accordance with these Terms and the Google Play rules.

You may not sell, rent or redistribute the App, nor decompile or disassemble it, except to the extent the law expressly allows.

3. Kortalo Pro: a one-time purchase through Google Play

The free version calculates, shows the results and shares the shopping list as text. Kortalo Pro unlocks additional features, described in the App before purchase.

  • Kortalo Pro is a one-time purchase, with no subscription and no renewal.
  • The price is shown by Google Play, in your currency, before you confirm the purchase. Applicable taxes are calculated and collected under the Google Play rules.
  • Payment is handled by Google Play. We process no payment and receive no card or identity data.
  • Refunds follow the Google Play rules and are requested from Google Play. For a situation those rules do not cover, write to us at the address in section 11.
  • The purchase is linked to your Google account: it can be restored in the App on a device signed in to the same account (“Restore purchase”).

4. Your data

Your projects, plans, offcuts and settings stay on your phone. We have no access to them and cannot recover them for you. Backing them up, with the means the App and Android provide, is up to you.

The handling of personal information is described in the privacy policy, published at kortalo.com/privacy/ and in the App, which forms part of these Terms.

5. Results are cutting proposals

The plans, shopping lists, costs and offcuts computed by the App are proposals based on the data you enter. They depend on the accuracy of that data and on the limits of the calculation, described in the App’s help.

  • Before buying or cutting, check your measurements, your stock and your prices.
  • The App does not calculate the strength of a piece or the sizing of a structure, and does not take defects in the material into account.
  • Safety in the workshop is your responsibility: use of tools, protective equipment, manufacturers’ instructions. Instructions read aloud do not replace your attention.

6. Intellectual property

The App, the kortalo.com website, their texts, their drawings and the Kortalo brand remain our property. These Terms grant you no right other than the licence in section 2.

The projects you create and the files you export belong to you.

7. Warranties

The App is provided as is. We fix and improve it, but we do not warrant that it is free of errors or fit for a particular purpose.

Some laws, including the Quebec Consumer Protection Act, do not allow certain warranties to be excluded: these exclusions then apply only to the extent the law allows, and your rights as a consumer remain.

8. Limitation of liability

To the extent the law allows, we are not liable for indirect damages arising from the use of the App or from being unable to use it, including loss of material, time or data.

To the extent the law allows, our total liability is limited to the amount you paid for Kortalo Pro.

Nothing in these Terms excludes or limits a liability that cannot be excluded or limited under the applicable law.

9. Changes to the Terms

We may change these Terms. The version in force is published on this page, with its update date. A significant change will be announced on this page before it takes effect. Continuing to use the App after that date means you accept it; if you do not, you may stop using the App.

10. Governing law

These Terms are governed by the laws of Quebec and the federal laws of Canada that apply there. Any dispute falls under the competent courts of the judicial district of the head office of InnovE-Tech Solutions inc., in Quebec, subject to consumer protection rules that would allow you to go to the court of your place of residence.
